New code for prosecution

After high profile failures in Court cases where Disclosure of key evidence has been raised, the Crown Prosecution Service have new responsibilities when it comes to considering evidence before coming to a charging decision.

Partner and Higher Rights Advocate Hannah Jones from our Criminal Team said: “This new code for Prosecutors means that there is an added duty for prosecutors to consider much more digital and other types of evidence that exist in a much earlier stage in the life of a case and prevent cases being charged to court where there is clear evidence that points away from a particular suspect.”

The Criminal Team advise anyone asked to speak to the Police to make contact with us first. There is no such thing as a ‘friendly chat’ at the Police Station and you will be entitled to FREE legal advice for any interview, whether arrested or not. You may qualify for further legal aid and our team of experienced Solicitors and Advocates can ensure that disclosure and other matters are followed up and your rights enforced.  If you are experiencing problems contact our Crime Team at crime@churchers.co.uk or 023 9282 0747 for Portsmouth, and 01983 817 060 for Ryde.
