Cyclist Facing Bankruptcy

Following the recent news that a cyclist is facing bankruptcy following a payout to a pedestrian he hit on a busy London road, Churchers Solicitors are advising local cyclists to ensure they have the right insurance and legal advice should similar events happen to them.

The south coast firm has advised that cyclists should be taking out insurance policies with British Cycling or other providers to give protection and cover in situations such as this. The insurer would have dealt with the claim to save this cyclist having to pay out of his own pocket. The insurer would also have its own legal team able to advise this individual on the counterclaim etc.

Getting early legal representation is vital in ensuring individuals get the best possible advice as soon as possible.  Areas they could have help with include:

  • early advice on liability and defending the claim
  • assistance drafting Court documents such as the Defence to ensure all bases were covered
  • advice on options for a counterclaim and/or to set off against the cyclists claim
  • advice on the possibility of early settlement without the need for a trial
  • assistance minimising the legal costs to the cyclist.
